By accessing or using the website at visaliamasonry.com (the "Site") or by engaging the services of VLM Visalia Masonry ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. VLM Visalia Masonry provides residential and commercial masonry contracting services, including but not limited to foundation repair, chimney repair, brick and stone masonry, retaining wall construction, tuckpointing, and related masonry work in the Visalia, CA area and surrounding communities. The Site is used to provide information about these services and to receive estimate requests. Nothing on the Site constitutes a binding offer to perform work. All work is formalized through a separate written agreement or signed estimate between the Company and the customer.
All estimates provided by the Company are based on an on-site assessment of the project. Written estimates are valid for 30 days from the date of issue unless otherwise stated. Estimates are not guarantees of final price. The final price may change if:
We will notify you in writing before performing any work that falls outside the original scope. No additional charges will be incurred without your prior approval.
Once a project is scheduled, we ask that you provide at least 48 hours notice if you need to cancel or reschedule. Cancellations made with less than 48 hours notice may result in a cancellation fee to cover crew scheduling costs. Any deposits paid toward materials or permits that have already been ordered are non-refundable.
We reserve the right to reschedule work due to weather conditions that would compromise material curing or crew safety. In these cases, we will contact you as soon as possible and reschedule at no additional charge.
Payment terms are specified in the written agreement for each project. In general:
Invoices not paid within the timeframe stated in your agreement may be subject to a late fee. The Company reserves the right to place a mechanics lien on the property for unpaid balances as permitted under California law.

Any warranty on completed work is as specified in your written project agreement. In the absence of a written warranty, work is provided as-is. Warranty coverage applies to workmanship defects under normal conditions and does not cover:
The Site itself is provided on an "as-is" and "as-available" basis. We make no warranties, expressed or implied, regarding the accuracy, completeness, or reliability of any content on the Site.
To the fullest extent permitted by applicable law, VLM Visalia Masonry shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your use of the Site or our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to these terms or our services shall not exceed the amount actually paid by you to the Company for the specific work giving rise to the claim.
All content on the Site, including text, images, logos, and layout, is the property of VLM Visalia Masonry or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Site content without prior written permission.
Before initiating any formal legal proceeding, both parties agree to make a good-faith effort to resolve any dispute directly by contacting us at the email address below. If the dispute cannot be resolved informally within 30 days, either party may pursue binding arbitration in Tulare County, California, under the rules of the American Arbitration Association. The prevailing party in any arbitration or legal proceeding shall be entitled to recover reasonable attorney fees and costs.
You agree that you will not bring any class action or representative action against the Company.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in Tulare County, California.
We reserve the right to update or change these Terms and Conditions at any time. When changes are made, we will update the effective date at the top of this page. Continued use of the Site after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
